Murrays Privacy Policy

Murrays Australia Limited (Murrays) is bound by the National Privacy Principles (NPP's) which explain how businesses are able to collect and deal with personal information about individuals.

This Privacy Statement explains how Murrays will deal with personal information obtained by it which is covered by the National Privacy Principles. Murrays is committed to ensuring that everyone within the organisation understands and complies with the privacy principles.This policy aims to help ensure that occurs.

The 10 National Privacy Principles

The 10 NPP's relate to:

  2. use and disclosure of personal information
  3. data quality
  4. data security
  5. openness
  6. access and correction
  7. identifiers
  8. anonymity
  9. transborder data flow
  10. sensitive information

How Murrays will apply the privacy principles to relevant Personal Information

Collection of Personal Information

We will only collect information that we reasonably need to conduct our business and we will be fair about how we collect information. Where possible we will try to collect information directly from the person concerned.

Murrays recognises the sensitivity of receiving credit card information from customers in the course of its business. Murrays will only collect and use that information for the purposes it is disclosed related to Murrays business requirements and will not use the credit card information for any other purpose other than the purposes for which it is collected.

Use and Disclosure of Personal Information

We will inform you, (either in established policies or otherwise), about who else might be provided with personal information by Murrays related to Murrays conducting its business or for other proper purposes.

We will use the personal information we collect only for the purposes of collection or a related purpose. We will obtain consent of the person concerned if we wish to use the information for another reason.

Other commitments

We will take reasonable steps to ensure personal information is accurate and protect personal information from misuse, loss or unauthorised access or disclosure.

We will be open about the kinds of personal information held by us in relation to you and will give you access to personal information about you and correct it if it is wrong.

We will only collect sensitive information with your consent, as required by law or where necessary in accordance with the privacy principles.

Guidelines for Other Organisations

Murrays will also prepare privacy guidelines for others who may receive personal information from Murrays relating to Murrays conducting its business or for another proper purpose. Murrays will take steps to ensure that those to whom personal information is provided are aware of their privacy obligations and committed to ensuring their obligations are met.

Access to personal information

If Murrays holds personal information about a person to which the Privacy Principles apply, it must allow the person access to the information on request if the person wishes to access personal information held by Murrays unless it is exempt information or a relevant exception applies. A request should be made in writing to the Personnel Department. Murays will arrange to make the information available as soon as reasonably practical and will seek to do so within 14 days if possible. At the time of your request, Murrays will advise you if an exception applies and will explain that exception to you.

The exceptions to Murrays providing a person with access to their personal information include:

  • providing access would have an unreasonable impact upon the privacy of other persons; or
  • the request for access is frivolous or vexatious; or
  • the information relates to existing or anticipated legal proceedings between Murrays and the person, and the information would not be accessible by the process of discovery in those proceedings.

Murrays may charge for providing access to personal information provided those charges are not excessive and do not apply to lodging a request for access.

Correcting personal information

If the individual and Murrays disagree about whether the information is accurate, complete and up-to-date, and a person asks Murrays to attach with the information a statement claiming that the information is not accurate, complete or up-to-date, Murrays must take reasonable steps to do so.

Murrays must provide reasons for denial of access or a refusal to correct personal information.

Application of Policies

These specific access and correction policies apply in relation to personal information collected by Murrays after 21 December 2001. These policies also apply to personal information collected by Murrays before 21 December 2001 and used or disclosed by Murrays after 21 December 2001, except to the extent that compliance with these policies in relation to the information would place an unreasonable administrative burden on Murrays or cause Murrays unreasonable expense.
